The 13th month salary is usually paid at the end of the fiscal year, so it often falls on Tet holiday, so many companies combine it into a Tet bonus. Because it is called the 13th month salary, many workers assume that this is something businesses must do. But in reality, Tet bonus and 13th month salary are not mandatory.
In Clause 1, Article 6 of the 2019 Labor Code stipulates the Rights and obligations of employers:
Employers have the following rights:
a) Recruitment, placement, management, administration and supervision of labor; reward and handle violations of labor discipline.
Because it is a right, the employer can exercise it or not. That is, you can exercise your rights or not exercise your rights.
At the same time, Article 104 of the Code 2019 stipulates bonuses as follows:
1. Bonus is the amount of money or property or in other forms that the employer rewards the employee based on the employee’s production and business results and job completion level.
2. Bonus regulations are decided by the employer and publicly announced at the workplace after consulting with the grassroots employee representative organization for places where there is an employee representative organization at the workplace. department.
Thus, the bonus is not mandatory but will be based on production and business results, the level of work completion of the employee, even on holidays such as April 30 – May 1 or National Day on the 2nd. /9, if the company does not give bonuses, it is not against the regulations.
However, that is from a legal perspective, but from a human resources perspective, I still wish that companies could build bonus funds, have clear bonus policies and, above all, have Tet bonuses. Therefore, companies should not be too strict and think that if the law does not require it, they should not do it, and employees should not be too demanding because they think it is an obvious thing that businesses must do.
