According to Article 31 of the 2017 Law on Tourism, regulations on travel service business conditions are as follows:
1. Conditions for domestic travel service business include:
a) Is an enterprise established according to the provisions of law on enterprises;
b) Make a deposit for domestic travel services business at a bank;
c) The person in charge of travel services business must have graduated from intermediate school or higher with a major in travel; In case of graduating from intermediate school or higher in another major, a certificate of domestic tourism operations must be obtained.
2. Conditions for international travel service business include:
a) Is an enterprise established according to the provisions of law on enterprises;
b) Deposit money for international travel services business at the bank;
c) The person in charge of travel service business must have graduated from college or higher with a major in travel; If you graduate from college or higher in another major, you must have a professional certificate in international tourism operations.
Specifically, first, about the person in charge of the travel service business.
According to the instructions in Circular 06/2017/TT-BVHTTDL and Circular 13/2019/TT-BVHTTDL amending and supplementing Circular 06/2017/TT-BVHTTDL, the person in charge of travel service business is the person holding one of the following positions: chairman of the board of directors; Chairman of the Board of Members; company president; private business owners; general manager; director or deputy director; Head of travel services business.
If the person in charge of the travel service business has graduated from intermediate school or higher in another major, he or she must have a certificate in tourism operations. The content of training in tourism operations includes:
1. The content of professional training in domestic tourism management includes:
a) Basic industry knowledge: Vietnamese political system; legal documents related to tourism; Tourism Overview; tourism marketing; tourist psychology and communication art;
b) Specialized knowledge and tourism operations skills: overview of travel service businesses; tourism market and tourism products; product design and tour program pricing; tourist areas and tourist attractions in Vietnam; tourism management operations; sales and customer care; marketing and communications; domestic air transport procedures; applying information technology in business management and development;
c) Practice domestic tourism operations.
2. The content of training in international tourism operations includes:
a) Basic industry knowledge: Vietnamese political system; legal documents related to tourism; Tourism Overview; tourism marketing; tourist psychology and communication art; international cultural exchange;
b) Specialized knowledge and tourism operations skills: overview of travel service businesses; tourism market and tourism products; product design and tour program pricing; tourist areas and tourist attractions in Vietnam; tourism management operations; sales and customer care; marketing and communications; currency and international payments in tourism; immigration operations; domestic and international air transport procedures; applying information technology in business management and development;
c) Practice international tourism operations.
Second, the travel major specified in Point c, Clause 1 and Point c, Clause 2, Article 31 of the Law on Tourism is shown on the diploma of one of the following professions, occupations, and majors:
a) Tourism and travel service management;
b) Travel management;
c) Tour operator;
d) Tourism marketing;
d) Tourism;
e) Travel and tourism;
g) Tourism management and business;
h) MICE tourism management;
i) Travel agency;
k) Travel guide;
l) Industry, profession or major that includes one of the phrases “tourism”, “travel”, “tour guide” trained by educational institutions in Vietnam and issued diplomas before the time of This Circular takes effect;
m) Industry, profession, or specialty that represents one of the phrases “tourism”, “travel”, “tour guide” trained and awarded diplomas by foreign training establishments.
In case the diploma does not show the majors, occupations, or majors specified in Points l and m of this Clause, add a graduation transcript or diploma appendix showing the majors, occupations, and majors, including one in the phrases “travel”, “travel”, “travel guide”.”
In case a diploma is issued by a foreign training institution, it must be recognized according to the regulations of the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs.
Third, about deposit.
In Article 14 of Decree 168/2017/ND-CP and amended and supplemented in Decree 94/2021/ND-CP, regulations on deposit levels are as follows:
1. Deposit level for domestic travel services business: 20,000,000 (twenty million) VND.
2. Deposit level for international travel services business:
a) Travel service business for international tourists coming to Vietnam: 50,000,000 (fifty million) VND;
b) Travel service business for tourists going abroad: 100,000,000 (one hundred million) VND;
c) Travel service business for international tourists coming to Vietnam and tourists going abroad: 100,000,000 (one hundred million) VND.
Enterprises make deposits in Vietnamese Dong at commercial banks, cooperative banks or foreign bank branches established and operating in Vietnam and receive interest rates according to the agreement between the enterprise and the bank. Receive deposits in accordance with the provisions of law. The deposit must be maintained for the duration of the travel business.
